By accessing the Website, you agree to be bound by these Terms and Conditions. Accordingly, you should check the date of the Terms and Conditions (which appears at the bottom of this document). If, at any time, you do not agree with the Terms and Conditions of this site, please do not make use of the Website.

Protect The West Coast (including its board members, volunteers, employees, suppliers, Internet service providers, partners, affiliates, agents and/or representatives) shall not be liable for any damage, loss or liability of any nature incurred by accessing this Website, including but not limited to loss or damage arising from content available on the Website.

Without derogating from the aforegoing, Protect The West Coast hereby authorises the user to view, share on social media, in print and email, the content of this Website, provided that:
Such information is used for non-commercial purposes only; and
Any reproduction of the content of this Website, or portion thereof, must include the following credit: www.protectthewestcoast.org

You may not otherwise access, display, use, download, or otherwise copy or distribute content from this Website for marketing and other purposes without our consent. Users that wish to use content from this Website for commercial purposes may only do so with prior written permission of the Directors.

While Protect The West Coast does take all necessary steps to ensure the accuracy of the content and information on this site, the Company does not make any warranties or representations that such content and information shall in all cases be true, correct or free from any errors.

Transactions

You may transact on this Website as a guest, where you will not be required to register prior to making any online purchases.

By using the Website shop, you warrant that you are 18 years of age or older and/or have full legal capacity to transact. If you are under the age of 18, or if you are not legally permitted to enter into a binding agreement, then you may use the Website only under supervision, and with the consent of your legal guardian. The legal guardian of any person(s) using this site under supervision gives his/her consent and agrees to be bound to these Terms and Conditions and to be liable and responsible for all User obligations under these Terms and Conditions.

You acknowledge that goods displayed on the site are subject to availability of stock. If goods ordered by the User are not available, we will let you know as soon as possible. We have made every effort to accurately display the goods on the site with regard to their description, colour, size and price. The colours you see, however, will depend on the device which you are using to access the site and we cannot guarantee that the goods, when received, will be the exactly same colour as that showcased on www.protectthewestcoast.org

By placing an order with us, you will be deemed to have read, understood and agreed to these Terms and Conditions. By placing an order via this Website, you are making an offer to www.protectthewestcoast.org to purchase the goods detailed in your order upon the terms described in your order.

We reserve the right at any time to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation. We reserve the right, at our sole discretion, to limit the quantity of items purchased to prohibit sales to retailers.

In the event that a product is listed at an incorrect price, we shall have the right to refuse or cancel orders for the product listed at the incorrect price, regardless of whether the order has been confirmed and/or payment has been made. If you have already made payment for the purchase and your order is cancelled, we will issue a refund for the amount you have spent.

www.protectthewestcoast.org will indicate the acceptance of your order by delivering the products to you or and only at that point will an agreement of sale between you and the Website come into effect. This is regardless of any communication from www.protectthewestcoast.org stating that your order or payment has been confirmed. www.protectthewestcoast.org will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid, or replacing your selected products with other products or a voucher, as agreed with you.

We cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the site), which may result due to the lack of adequate virus protection software or spyware that the user may inadvertently have installed on his/her device.

Disclaimer

The information, services, products offered for sale and materials contained in and/or advertised on the site, including, without limitation, text, graphics and linked, are provided on an “as is” basis with no warranty. To the maximum extent permitted by law, Protect The West Coast, www.protectthewestcoast.org and its suppliers disclaim all representations and warranties, express or implied, with respect to such information, services, products and materials, including, but not limited to, warranties of merchantability or fitness for a particular purpose, title, non-infringement, freedom from computer virus and implied warranties arising from course of dealing or course of performance.

Product Information

Products displayed on the site are available at www.protectthewestcoast.org while stocks last. The prices displayed on the site are quoted in South African Rands (ZAR). Please note that payments made via PayPal must be made in U.S. dollars.

All prices, pictures and descriptions on this site are subject to change. We maintain no responsibility for inadvertent errors. When you place your order with us, you agree to the price and terms indicated on our Website. Price differences related to future or past prices in our store or any other store’s prices are not refundable. Also note that the particular technical specifications and settings of your computer or device and its display could affect the accuracy of its display of the colours of products offered on the site.

We take responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer support, dispute resolution and delivery of goods.

Errors

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of goods on the Website. However, should there be any errors of whatsoever nature on the Website, we shall not be liable for any loss, claim or expense relating to a transaction based on any error, except – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.

Limitation on Liability
In no event shall Protect The West Coast, www.protectthewestcoast.org or any of its affiliated entities or suppliers be liable for any indirect, special, punitive, incidental, exemplary or consequential damages, even if Protect The West Coast and www.protectthewestcoast.org have been previously advised of the possibility of such damages, whether in an action, under contract, negligence or any other theory, arising out of or in connection with the use, inability to use or performance of the information, services, products and materials available from the site.

These limitations shall apply notwithstanding any failure of essential purpose or the existence of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.

Limits of Responsibility

We accept no responsibility for user initiated damage and/or loss of parts incurred during operation or use.
